eBriefings Survey Drawing Offical Rules

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. EMAIL SUBSCRIPTION NOT REQUIRED. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. TO ENTER: There are three (3) ways to enter: (1) Go to http://www.surveymonkey.com/NYASeBriefingsSurvey and complete all of the questions answered and enter your email address, as per the instructions; (2) Print your name, address, e-mail address, the name of the prize drawing and daytime telephone number (optional) on a 3.5" x 5" card and mail it to: eBriefings Survey Drawing, Marketing Department, New York Academy of Sciences, 250 Greenwich Street, 40th floor, New York, N.Y. 10007; or (3) Print the same information on a sheet of paper and fax it to us as 212-298-3646. The entry period will begin at 12:00 A.M. (E.D.T.) on August 15, 2008 and will close at 11:59 P.M. (E.D.T.) on October 31, 2008. Mail-in entries must be received by October 31, 2008, faxed entries must be received by 11:59 P.M. on October 31, 2008, and Internet entries must be received by 11:59 P.M. E.D.T. on October 31, 2008. If you do NOT wish to be entered in the drawing, e-mail us at ealerts@nyas.org. Please put "Exclude from eBriefings Survey Drawing" in the subject heading. If you have questions, e-mail us at ealerts@nyas.org. Please put "eBriefings Survey Drawing question" in the subject heading. Limit one entry per person during the entry period, regardless of method of entry. Multiple entries submitted by a single person, regardless of method of entry, are void.

2. ELIGIBILITY: Drawing open only to U.S. residents (excluding Puerto Rico), 18 years of age or older at time of entry. Drawing is not open to employees of the New York Academy of Sciences or the immediate family members of, and any persons domiciled with, such employees. This drawing is subject to all applicable federal, state and local laws of the United States. By participating, you agree that any claims must be resolved in a court in New York County in the state of New York. Void where prohibited.

3. PRIZES: Two prize winners will be selected by the Online Marketing Coordinator of the New York Academy of Sciences in a random drawing from among all eligible entries to be held on or about November 15, 2008. The prize is nontransferable and non-endorsable, and no cash or other substitutions will be offered except at the sole discretion of the New York Academy of Sciences. The New York Academy of Sciences has the right to substitute a prize of equal or greater value. The prize winners will receive an additional month of membership to the New York Academy of Sciences.

4. WINNER NOTIFICATION AND ACCEPTANCE: The prize winners will be notified by e-mail. Return of prize notification as undeliverable or failure to respond to the email may result in disqualification and an alternate winner may be selected. Each winner may waive his or her right to receive a prize. Prizes are non-assignable and nontransferable. No substitutions allowed, except that the prize is subject to availability and the New York Academy of Sciences reserves the right to substitute a prize of equal or greater value. The prize winners are solely responsible for reporting and payment of any taxes on the prize. The winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law), which will be provided to each winner by mail and must be returned to the New York Academy of Sciences by certified mail within 14 days of the date of notification. Failure to sign and return the affidavit or release within 14 days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of the New York Academy of Sciences, result in the winner's disqualification, the forfeiture of his or her interest in the prize, and the award of prize to an alternate winner. Except where prohibited by law, participation in the drawing constitutes the entrant's consent to the publication of his or her name and image in any media for any commercial or promotional purpose, without limitation or further compensation. For the prize winner list send a self-addressed, stamped envelope to Science & the City Weekly Subscribers Winner, Publishing Department, New York Academy of Sciences, 250 Greenwich Street, 40th floor, New York, N.Y. 10007. Residents of Vermont may omit postage.

5. ELIGIBLE ENTRANTS MUST ENTER VIA THE WRITE-IN, FAX, OR ONLINE METHODS DESCRIBED. All personal information collected in the course of this contest is subject to the terms of the New York Academy of Sciences' privacy policy. By entering this Drawing, each entrant agrees to be bound by these Official Contest Rules, including all eligibility requirements, and by all decisions of the New York Academy of Science and its agencies, which are final and legally binding in all matters relating to this Drawing. By entering, entrants and winner agree to release, discharge, indemnify and hold harmless the New York Academy of Sciences, its affiliates, officers, directors, representatives, agents, and employees from and against any claims, damages, or liability due to any damages, or losses or injuries to any person (including death) or property of any kind resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in any drawing-related activity or participation in this Drawing. Entrants further agree not to pursue any right, claim or action against the New York Academy of Science, its affiliates, officers, directors, representatives, agents, and employees in connection with their participation in this Drawing. Entrants must pay normal Internet access and usage charges imposed by their on-line service, if entering via the online method of entry. Incomplete entries are void. No mechanically reproduced, software-generated or other automated multiple entries permitted. The New York Academy of Sciences will not be responsible for incomplete, incorrect, garbled, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, device or software, whether originating with sender or sponsor, or for any human error, lost/delayed data transmission, or any other error or malfunction that may limit the ability to participate in this Drawing. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an e-mail account holder shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. All entries become the property of the New York Academy of Sciences and receipt of entries will not be verified. You agree that you shall not upload, post or transmit any materials which contain any computer viruses, worms, Trojan Horses or other harmful components or programming routines that are intended to damage, detrimentally interfere with, or harm any system, data or personal information. Entry materials that have been tampered with or altered are void. Any questions regarding the number of entries submitted or the owner of an e-mail account shall be determined by the New York Academy of Sciences in its sole, reasonable discretion, and the New York Academy of Sciences reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the drawing. The New York Academy of Sciences and its agencies are not responsible for damages to user's system occasioned by participating in the promotion or downloading any information to participate in the promotion. The New York Academy of Sciences reserves the right to modify or cancel the online portion of the promotion if it becomes technically corrupted. In such event, the New York Academy of Sciences would award prize from eligible online entries received prior to cancellation and all other eligible entries received.

6. SPONSOR: The eBriefings Survey Drawing is sponsored by the New York Academy of Sciences, whose decisions regarding the selection of the winner and all other aspects of the drawing shall be final and binding in all respects. The New York Academy of Sciences will not be responsible for typographical, printing or other inadvertent errors in these Official Drawing Rules, in other materials relating to the drawing, or the announcement of the winner.
